3. SMS Messaging Terms
By opting in to our SMS program, you agree to the following:
- You authorize CPTMS to send automated text messages to the mobile number you provide, including dispatch notifications, status updates, and operational alerts.
- You confirm that the mobile number you provide belongs to you or that you have authorization from the number's owner to enroll it.
- Message and data rates from your mobile carrier may apply. CPTMS is not responsible for charges assessed by your carrier.
- Message frequency varies based on active loads. Messages are operational in nature and not promotional.
- You may opt out at any time by replying STOP to any message. See our SMS Program page for full details.

4. User Responsibilities
You agree to:
- Provide accurate and truthful information when using our services
- Use the platform only for lawful freight and logistics purposes
- Not attempt to reverse-engineer, copy, or replicate our platform or its underlying systems
- Not use our SMS program to send unsolicited messages or for any purpose other than freight dispatch communications
- Maintain the confidentiality of any account credentials provided to you
5. Disclaimer of Warranties
CPTMS services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that our services will be uninterrupted, error-free, or that results obtained through the platform will be accurate or reliable. SMS delivery is dependent on third-party carriers and cannot be guaranteed.
6. Limitation of Liability
To the maximum extent permitted by applicable law, CPTMS shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to delays in freight delivery, missed communications, or errors in AI-generated data. Our total liability for any claim shall not exceed the amounts paid by you to CPTMS in the twelve months preceding the claim.
7. Third-Party Services
Our platform integrates with third-party services including SMS carriers, cloud hosting providers, mapping services, and AI providers. Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the actions or policies of third-party providers.
8. Intellectual Property
All content, features, and functionality of the CPTMS platform — including but not limited to software, text, graphics, and design — are owned by CPTMS and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.
9. Termination
We reserve the right to suspend or terminate your access to our services at our discretion, including if you violate these Terms or use our services in a manner that could harm CPTMS, its users, or third parties. You may stop using our services at any time.
10. Governing Law
These Terms are governed by the laws of the State of Illinois, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Illinois.
